These Terms of Service ("Terms") govern your access to and use of our website, products and services. By accessing hustlehood.com, placing an order, creating an account, or interacting with us, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Returns & Refunds Policy (together, the “Policies”).

Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).

1) Who we are

Hustle Hood is a registered business name of Creative Slate Media Pty Ltd (ABN [insert]). Our contact details are in Section 19.

2) Eligibility & account

  • You must be at least 16 years old to use the Site and at least 18 to make purchases.

  • You are responsible for keeping your account credentials confidential and for all activity under your account.

  • We may refuse service, close accounts, or cancel orders for any lawful reason.

3) Orders, pricing & payment

  • Offers & acceptance: Your order is an offer to buy. We accept when we send an order confirmation or dispatch notice.

  • Availability: Products are subject to availability. We may cancel all or part of an order (with a refund) if an item becomes unavailable or there is an error.

  • Pricing: Prices are shown in AUD unless noted. We may correct pricing or descriptive errors at any time. If we change the price after your purchase due to an error, you may cancel for a full refund.

  • Taxes: Prices may include GST where applicable. Duties/taxes for international orders are the recipient’s responsibility unless otherwise stated.

  • Payment: We accept payment methods shown at checkout and process payments via third‑party providers (e.g., Shopify Payments, PayPal). We do not store full card details.

4) Shipping & delivery

Shipping methods, costs, timeframes and restrictions are set out in our Shipping Policy. Delivery timeframes are estimates and may vary due to carrier delays, customs clearance or factors beyond our control. Risk of loss passes on delivery scan or as otherwise required by law.

5) Returns, refunds & consumer guarantees

Our Returns & Refunds Policy explains how to request a return, receive a refund, exchange or store credit, and hygiene restrictions for certain items (e.g., socks and hooded towels).

Under the ACL, you are entitled to a remedy if goods are faulty, not fit for purpose or not as described. For major failures, you can choose a refund or replacement. For minor problems, we may repair, replace or refund within a reasonable time. Any limitations in our Policies do not apply where the ACL requires otherwise.

6) Promotions, gift cards & bundles

  • Promotions: Subject to their stated terms. Unless noted, promotions cannot be combined and may be changed or withdrawn at any time.

  • Gift cards: Non‑refundable (except as required by law), not redeemable for cash, and expire no earlier than 3 years from purchase (or longer if required by local law). Keep your card safe; we are not responsible for lost or stolen cards.

  • Bundles: For change‑of‑mind, bundles must be returned complete to receive full credit (see Returns Policy).

7) User content & reviews

If you submit content (e.g., reviews, photos, social posts) you grant us a worldwide, royalty‑free, non‑exclusive licence to use, reproduce, adapt, publish and display that content for marketing and operating the Site, in accordance with our Privacy Policy. You represent that you own or have rights to the content and that it does not infringe others’ rights or contain unlawful material. We may moderate or remove content at our discretion.

8) Acceptable use

You agree not to:

  • use the Site for unlawful purposes;

  • attempt to gain unauthorised access to systems;

  • interfere with or disrupt the Site, including by uploading malware;

  • harvest data or use automated means without permission;

  • infringe intellectual property or privacy rights.

9) Intellectual property

All trademarks, logos, product designs, characters/mascots, graphics, text, photographs, videos and other materials on the Site are owned by us or our licensors and are protected by law. Except as permitted by law, you must not copy, modify, distribute or create derivative works without our prior written consent.

10) Third‑party services & links

The Site may include links to third‑party websites or services (e.g., payment processors, social platforms). We are not responsible for their content or practices. Your use of third‑party services is governed by their terms and privacy policies.

11) Pre‑orders & limited releases

Pre‑order items charge at checkout and ship on or around the estimated date. Dates are estimates and may change due to production or shipping delays. If a pre‑order is materially delayed, you may cancel for a full refund.

12) Warranties & disclaimers

Except as required by the ACL or other non‑excludable laws, the Site and products are provided “as is” and “as available.” We make no warranties about uninterrupted or error‑free access, or that defects will be corrected. To the extent permitted by law, we disclaim all other express or implied warranties.

ACL carve‑out: Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the ACL that cannot be excluded, restricted or modified.

13) Limitation of liability

To the maximum extent permitted by law, our liability for any claim arising out of or in connection with these Terms or the products/services is limited, at our option, to: (i) in the case of goods—replacement or repair of the goods, supply of equivalent goods, or payment of the cost of doing so; and (ii) in the case of services—resupplying the services or payment of the cost of resupply.

Nothing in these Terms limits liability for fraud, deliberate conduct, death or personal injury caused by negligence, or liability that cannot be limited under the ACL.

14) Indemnity

You agree to indemnify and hold Creative Slate Media Pty Ltd and our officers, employees and agents harmless from claims, losses, damages, costs and expenses (including reasonable legal costs) arising out of your breach of these Terms, unlawful conduct, or infringement of third‑party rights, except to the extent caused by our negligence or breach.

15) Privacy

We handle personal information in accordance with our Privacy Policy. By using the Site, you consent to our collection, use and disclosure of information as described there, including the use of cookies and pixels.

16) Changes to the Site or Terms

We may update the Site, our products, and these Terms from time to time. Changes take effect when posted on the Site, unless a later date is stated. If changes are material and affect existing orders, we will notify you where practicable. Your continued use of the Site after changes means you accept the updated Terms.

17) Suspension & termination

We may suspend or terminate your access to the Site at any time for any lawful reason, including if we reasonably believe you have breached these Terms. You may stop using the Site at any time. Sections that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability and indemnity).

18) Governing law & venue

These Terms are governed by the laws of Western Australia, Australia. You submit to the non‑exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia in relation to disputes arising out of these Terms or the Site.

20) Entire agreement

These Terms and the Policies constitute the entire agreement between you and us regarding the Site and supersede any prior understandings. If any part of these Terms is invalid or unenforceable, the remainder remains in effect.
